BT OC Timberlake LLC d/b/a Badger Lawn Services ("Badger", "us", "we") is a Limited Liability Company established and operating under the laws of the Commonwealth of Virginia and the United States of America; as such, We strive to abide by all laws and treaties applicable to Us. Through this dispute policy ("Policy"), We attempt to comply with both the Virginia Home Solicitation Sales Act (“HSSA”, Code of Virginia Title 59.1, Chapter 2.1) and the Virginia Consumer Protection Act of 1977 (Code of Virginia Title 59.1, Chapter 17), even though We might not be required to do so.

This policy complements all other Badger policies and should be read and construed consistent with all of them and with Badger terms and conditions.

We will not use your social security number as your account number.

We do not sell and will not install or maintain lawn darts or any children's product We know or have reason to know was recalled by the U.S. Consumer Product Safety Commission.

If you have a dispute involving a payment you have made via our consumer online portal, please contact your financial service provider: We do not have access to information regarding and therefore cannot directly resolve most payment disputes.

If you are dissatisfied with the services We have provided to you, you agree

to provide to Us specific information regarding your dispute and a full and complete explanation of the basis for your dispute. Upon receipt of such information and explanation, We will conduct a reasonable investigation and review. If We determine that your dispute is frivolous or irrelevant, We will notify you within five (5) business days.
to give us reasonable time, not less than ten (10) days, to attempt to accomplish remedial work to your satisfaction. If, after that period, you remain dissatisfied, We may, at our option, attempt to cure your claim by making a written offer of one or more things of value, including but not limited to the payment of money, reasonably calculated to remedy any demonstrable loss plus an additional ten percent (10%), up to a maximum of four thousand dollars ($4,000), as compensation for your inconvenience and all other costs of any kind that you may have actually incurred in relation to such demonstrable loss.

If We enter into a written agreement with you to resolve a dispute that arises in connection with a consumer transaction, We will adhere to the terms and conditions of such an agreement.

On occasion, We may make an automatic renewal or continuous service offer to you and, if We do so, We will attempt to make such offer in a clear and conspicuous manner and will, in visual or temporal proximity to such offer, request your consent. If you do not desire to accept such automatic renewal or continuous service offer, you agree to let us know via telephone (434-247-2551 or, toll-free, 877-476-2243) or electronic mail (mailto:Burt@BadgerLawn.com).

On occasion, We may offer you Badger services at your residence without prior invitation or appointment and, if We do so, the following conditions apply:

We will present to you a fully completed receipt for any cash or credit card sale or will obtain your signature on a written agreement which designates as the date of the transaction the date on which you sign.
Buyer's Right To Cancel
If the agreement was solicited at a residence and you do not want the services, you, the buyer, may cancel the transaction at any time prior to midnight of the third business day after the date of the transaction. If, within the aforementioned three (3) day period, you elect to cancel your agreement with us, We will, within ten (10) days tender to you any payment(s) you have made pursuant to the agreement. If We have performed any services pursuant to a home solicitation sale prior to its cancellation, We are not entitled to and will not request any compensation.
