BT OC Timberlake LLC d/b/a Badger Lawn Services ("Badger", "us", "we") is a Limited Liability Company established and operating under the laws of the Commonwealth of Virginia and the United States of America; as such, We strive to abide by all laws and treaties applicable to Us. When you use Badger online services, you are coming to Us: We are not coming to you. Through this privacy policy ("Policy"), We attempt both to comply with the Virginia Consumer Data Protection Act (“VCDPA”, Code of Virginia Title 59.1, Chapter 53), even though We might not be required to do so, and to explain to you how personal information you provide to Us is collected, used, and shared. This Policy is not a contract and We may change it at any time We choose, without notice to you. If you have questions regarding this Policy or the privacy practices We implement, please contact Us in writing via mail addressed to the BT OC Timberlake LLC registered agent on file with the Clerk of the Virginia State Corporation Commission.

Throughout this Policy, We contemplate information which pertains to consumer-facing services utilized by a natural person acting in his individual or household capacity. If you are a business, an employee, or a natural person acting as an independent contractor, this Policy does not apply to you; however, a dfferent privacy policy may contain information detailing how your personal information is handled and We urge you to consult any such privacy policy.

This policy complements all other Badger policies and should be read and construed consistent with all of them and with Badger terms and conditions.

Badger services may contain links to websites and other online services operated by third parties. In addition, Badger content may be integrated into web pages or other online services that are not associated with Us. These links and integrations are not an endorsement of, or representation that We are affiliated with, any third party. We do not control websites or online services operated by third parties, and We are not responsible for their actions.

If you are under the age of eighteen (18), are domiciled in the State of California, or reside in a jurisdiction having statute(s) demanding information more detailed than or differing from that which is contemplated by this Policy, you are not authorized to use any products or services made available by Us and any access you make to such products or services is trespass. We do not offer any services to any natural person under the age of eighteen (any "Child"). If We learn that We have collected personal information from a Child without the consent of the Child’s parent or guardian, We will delete such information.

We may retain your information in Badger records as long as we deem appropriate. Do not provide Us with any information you may wish to retract, as We may be unable to satisfy any future retraction request.

We do not alter the data collection and use practices described in this Policy when We receive a so-called “Do Not Track” signal from you or any device or software you might use.

We employ a number of technical, organizational, and physical safeguards designed to protect the personal information We collect. However, no security measures are failsafe, We cannot guarantee the security of your personal information, and We make no warranty whatsoever regarding the security of your personal information.

Personal Information We Collect And Process

The information We collect and process can be described as being of one of four distinct categories.

  1. We collect and process information you provide to Us, including but not limited to the following:
    • Contact details, such as your business name, job title, first and last name, email address, mailing address, and phone number;
    • Communications that We exchange with you, including when you contact Us with questions, feedback, or otherwise;
    • Information needed for Know Your Customer (“KYC”) checks performed by Us, such as dates of birth, social security numbers, and nationality or citizenship information;
    • Marketing data, such as your preferences for receiving Badger marketing communications and details about your engagement with them; and
    • Other data you provide, which we will use as described in this Policy or as otherwise disclosed at the time of collection.
  2. We may combine personal information We receive from you with personal information We obtain from other sources, such as:
    • Third parties, such as data brokers or business partners; and
    • Public sources, such as social media platforms.
  3. We may also automatically log information about you, your computer or mobile device, and your interaction over time with Badger websites, Badger communications, and other online services, such as:
    • Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers, language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and general location information such as city, state or geographic area; and
    • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to Badger website, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened Badger marketing emails or clicked links within them.
    The tools We may use for such automatic data collection include the following:
    • Cookies, which are text files that websites store on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, and helping us understand user activity and patterns;
    • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications; and
    • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.
  4. In addition to all of the above, We may derive information or draw inferences about you based on the information We collect. For example, We may make inferences about your approximate location based on your IP address.

How We Use Personal Information

We use personal information for the following purposes, among others:

  • Marketing, sales, and contracting, including to engage with potential customers and vendors, negotiate and enter into agreements, and maintain relationships with Badger customers. We may also use the information for direct marketing by email and other means.
  • Service delivery, including to
    • Provide, operate, and improve Badger services and Badger business;
    • Communicate with you about Badger services, including by sending announcements, updates, security alerts, and support and administrative messages; and
    • Provide support for Badger services and respond to your requests, questions, and feedback.
  • Research and development. As part of these activities, We may create aggregated, de-identified or other anonymous data from personal information We collect. We will use this data only in de-identified form and will not attempt to re-identify it except as permitted by law.
  • Compliance and protection. We may use your personal information to
    • Comply with applicable laws, lawful requests, and legal process, such as to complete KYC checks and respond to subpoenas or requests from government authorities;
    • Protect Badger, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims);
    • Audit Badger internal processes for compliance with legal and contractual requirements and internal policies;
    • Enforce the terms and conditions that govern Badger website and Badger services; and
    • Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

How We Disclose Personal Information

We may disclose any or all of your personal information to

  • Affiliates. Badger corporate affiliates, for purposes consistent with this Policy;
  • Vendors. Companies and individuals that provide services on Badger's behalf or help Us operate Badger services or Badger business (such as hosting, information technology, customer support, email delivery, identity verification/fraud prevention, and website analytics services);
  • Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to Us);
  • Authorities and others. Law enforcement, government authorities, and private parties, as We believe in good faith to be necessary or appropriate for the compliance and protection purposes described above; and
  • Business transferees. Acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Us or Badger affiliates (including, in connection with a bankruptcy or similar proceedings).
We may also disclose aggregated or de-identified information that cannot reasonably be used to identify you to other recipients not listed above.

Your Choices

Among other things, you may choose to

  • Opt out of marketing communications. If you have signed up to receive marketing communications from Us, you may opt out of marketing-related email communications by following the opt out or unsubscribe instructions contained in the marketing communications We send you.
  • Reject Cookies. Most browser settings let you delete and reject cookies placed by websites. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, you may not be able to use all functionality of Badger services and Badger services may not work properly.   • Select Another Provider. While We appreciate your business, We will accept your choice to use the website and services of a competitor.
